ARE YOU INVOLVED IN THE SALE OF A NEW HOME TO BE BUILT?. . . When working with a new home builder, regardless as to whether the buyer is your client or customer, make sure that you fully understand the terms of cooperation and compensation as offered by the new home builder. In particular, make sure that you understand how the commission is to be calculated. For example, is the commission to be based upon the purchase price of BOTH the land and the home to be built - or simply upon the purchase price of the home to be built exclusive of the purchase price of the land? Additionally, is the commission to be based upon the base price of the model home or is it also calculated upon the value of upgrades to the model home? You should ensure that you fully understand how your compensation is to be calculated and paid by the builder in order to avoid later disputes.
