Calling all PGCAR achievers!
Due This Friday ~ February 13, 2009

Application for 2008 PGCAR Achievement Awards is open to all current Primary members of PGCAR holding a broker's or salesperson's license and in good standing since on or before July 1, 2008. However, members licensed for the first time during 2008 must be a Primary Member of PGCAR in good standing since on or before September 30, 2008. (Note: Membership in MRIS does not automatically constitute membership in PGCAR.)

 
Bronze Awards:
Resales or New Homes
Total volume for
combined sales and listings sold must be $2,500,000.
 
 
Silver Awards:
Resales or New Homes
Total volume for
combined sales and listings sold must be $5,000,000.
 
 
Gold Awards:
Resales or New Homes
Total volume for
combined sales and listings sold must be $7,500,000.

 
 
Platinum Awards:
Resales or New Homes
Total volume for combined sales and listings sold must be $10,500,000.
 
 
Rookie of the Year:
Applicant must have completed first full license year or less at the option of the applicant any time during 2008 and must provide proof of date entrant was first licensed. Applicants are only eligible if they are a first year licensee and have not been licensed in any other jurisdiction previously. Transactions must have been completed during the first twelve (12) months of licensing.

IN MEMORIAM

With sadness we share that Herb Staples passed away on Thursday, January 29. Herb was formerly an agent with Carrollton Realty and a long-time member of PGCAR. Funeral services were private. We extend our sincere sympathy and prayers to Herb's family and friends.

2009 MAR LEGISLATIVE DAY - Rescheduled for Feb 25

The Maryland Association of REALTORS® Annual Legislative Day is rescheduled for Wednesday, February 25th at the Loews Annapolis Hotel. The program begins at 3:30 p.m. with registration starting at 3 p.m. Key Legislative officials have been invited and the program will feature various guest speakers briefing us on top issues affecting REALTORS® in the upcoming 2009 General Session. A reception will follow at 6 p.m. and will conclude at 8 p.m.

REALTORS® and their guests are welcome to attend the 3:30 Legislative Day Program FREE. All are also welcome to attend the evening reception for a modest $15 "cover" for drinks and hors d'oeuvres.

Code of Ethics Case Study: Case #10-5: Use of "Choose Your Neighbor"
Form Letters as Part of a Marketing Campaign

The ABC Board of REALTORS® received a complaint from a local fair housing group alleging that REALTOR® A was using discriminatory marketing techniques, in violation of Article 10 of the Code of Ethics, as the listing broker for a property in a new subdivision.

In support of their complaint, the fair housing group provided copies of "Choose Your Neighbor" form letters sent by REALTOR® A to current neighborhood residents. The letters announced that the property was on the market and invited neighborhood residents to contact REALTOR® A if they knew of anyone who they thought might be interested in purchasing the home.

At the hearing, REALTOR® A defended his use of "Choose Your Neighbor" form letters by demonstrating that they were just one element of his marketing campaign, and were not an attempt to restrict access to the property on the basis of race, color, religion, sex, handicap, familial status, or country of national origin as prohibited by Article 10. REALTOR® A produced copies of advertisements run in several newspapers, "OPEN HOUSE" flyers distributed at supermarkets throughout the town, and a copy of the property data sheet submitted to the Board's MLS. REALTOR® A remarked, "In my experience, the current residents of a neighborhood often have friends or relatives who have said that they would love to live in the neighborhood. It just makes sense to me to include contacting these folks in any marketing campaign!"

LEGAL ALERTS: CHANGES IN RESPA LAW NOW EFFECTIVE

NEW REAL ESTATE SETTLEMENT PROCEDURES ACT ("RESPA") RULES
The purpose of the reform, according to HUD, is to improve the disclosure of the key loan terms and closing costs consumers pay when they buy or refinance their home. Every settlement service provider will be affected by the reform, including the mortgage industry, the title insurance industry, real estate brokers and agents, and homebuilders. While the final rule allows one year to implement the use of the new Good Faith Estimate and the new HUD-1, there are certain components of the final rule that became effective January 16, 2009.

Montgomery County Law now requires that any advertisements, sales brochures, signs, or other sales material (electronic or printed), as of January 26, must include notice that:

  • the property is or would be located in a development district; AND
  • any potential buyer should ask the seller about the additional taxes and other charges for which a property owner in the district may be liable
