Taking Advantage of Federal Homebuyer Tax Credits?

Visit the PGCAR.com home page this week and click on the Economic Stimulus Legislative Alert for details on the Neighborhood Stabilization Plan (down payment closing cost assistance for buyers of foreclosed properties) and improved tax credits immediately available to homebuyers from the American Recovery and Reinvestment Act signed into law on February 17, 2009. Articles will remain available in PGCAR.com Legislative News. PGCAR is continuing to offer many training seminars and CE classes to help prepare you for NSP opportunities. A 3 CEU FHA 203K Purchase Rehab class covering NSP is offered at this Friday's (March 13) Education Day.

Fannie Instructs Its Servicers Not to
Cut Commissions on Short Sales

On February 24, 2009, Fannie Mae sent Announcement 09-03 to its servicers instructing them not to negotiate commissions on short sales below the amount negotiated by the listing agent (unless the commission exceeds 6 percent). The requirement took effect March 1, 2009.

Home Valuation Code of Conduct (HVCC)

On December 23, 2008, New York State Attorney General Andrew M. Cuomo, Fannie Mae and Freddie Mac (government sponsored enterprises) announced the final agreement of the Home Valuation Code of Conduct (HVCC). The agreement establishes standards on solicitation, selection, compensation, conflicts of interest and appraiser independence. The HVCC is effective May 1, 2009, for any mortgage that will be sold to the GSEs. Federal Housing Administration (FHA) and Federal Home Loan Bank (FHLB) mortgages are not covered in the agreement.

Code of Ethics Case Study: Case #11-1:
Appraiser's Competence for Assignment

REALTOR® A sold a light industrial property to Buyer B, a laundry operator. Several months later, Buyer B engaged REALTOR® A's services to appraise the property and to supply an appraisal report for use in possible merger with another laundry. REALTOR® A carried out this appraisal assignment and submitted his report. Buyer (now Client) B was dissatisfied with the report feeling that the valuation, in comparison with the market price that he had paid was excessively low. Client B then engaged an appraiser specializing in industrial property, and after receiving the second appraisal report, filed a complaint with the Board of REALTORS® charging REALTOR® A with the incompetent and unprofessional service as an appraiser.

At the hearing, questioning established that REALTOR® A could cite no other industrial property appraisal he had made, and that his appraisal experience had been limited exclusively to residential property. The hearing also established that when the client proposed the appraisal, REALTOR® A had readily accepted the assignment and that he had at no time disclosed the extent and limitations of his appraisal experience with his client.
