THE HOMEBUYERS TAX CREDIT EXPIRES IN 69 DAYS

URGE CONGRESS TO EXTEND AND EXPAND INTO 2010

NAR has launched an urgent, all member Call for Action (CFA) to ask Congress to extend the homebuyer tax credit.

You may have received the Call for Action email from the REALTOR® Action Center asking you to send your message to Congress. Please respond immediately. The tax credit is working, but to keep the housing market moving in the right direction, it is vital that it is extended through 2010.

If you did not receive the CFA, no problem! Please go to the REALTOR® Action Center directly, to send your letter asking Congress to extend and expand the tax credit.

Encourage everyone you know to contact Congress and let them know the importance of this tax credit. There are homebuyers who are looking now who will NOT be able to settle before the November 30 deadline, and will not qualify for this $8,000 tax credit if it is not extended.

BUYER HESITATION IS DISSOLVING
After 4 years of declines, national home sales appear to be turning around. Settlements have risen 3 straight months; pending contracts have risen 5 straight months. What's more, home prices and mortgage payments in relation to income are comfortably below historical levels in many markets.

First-time buyers in particular have stepped up to take advantage of deeply discounted prices, low mortgage rates, and the buyer tax credit. The unemployment rate in 2010 is expected to be at around 10 percent, but because consumers' view of home values is fundamentally changing, the momentum of rising home sales will likely continue in 2010. Buyers are no longer hesitant about home purchases on the fear of further price declines.

HOMEBUYER EDUCATION CLASSES
Offer a Class to Learn and to Earn Government Funds for a Downpayment on Dream Home

Homebuyers wishing to take advantage of Neighborhood Stabilization Plan (NSP) funds are required to complete eight hours of FHA/HUD approved housing counseling. You can offer these classes FREE to the home buying public through your membership with PGCAR. After completion of the required eight hour course, attendees will be provided with the documentation necessary to qualify them for NSP down payment assistance. All classes will be held at the PGCAR offices.

NON-RENEWED DC SALESPERSON LICENSES EXPIRED AUGUST 31

If you missed the DC license renewal deadline, you have until October 31, 2009 to renew your license with a late fee of $50.00 at the DCREC license renewal website.

There are tutorials for Brokers and for Salespersons at the license renewal website. For any renewal technical questions or problems, please call Pearson-VUE at 1-888-204-6192 for renewal instructions, and additional details.

Until your license is renewed, you are not authorized by the District of Columbia to practice real estate in DC. If listed as DC licensed in your PGCAR.com Member profile, please uncheck DC licensing until your license is reinstated. After license renewal, you may re-check DC state licensing at PGCAR.com with a click of the mouse.

Code of Ethics Case Study: Case #6-6: Disclose Affiliated Business Relationships Prior to Recommending Real Estate-Related Products or Services

REALTOR® Z, a broker and sole proprietor, had invested considerable time, money and energy into developing her website. Seeking to recoup some of her costs, she approached virtually every provider of real estate-related products and services in her area, including financial institutions, title insurance companies, home inspectors, mortgage brokers, insurance agencies, appraisers, exterminators, decorators, landscapers, furniture and appliance dealers, rug and carpet dealers, moving companies, and others about advertising on her home page. As a condition of having a link to their own sites appear on her home page, REALTOR® Z required that a fee be paid to her each time a consumer "clicked through" from her site to an advertiser's.

Ads for providers of real estate-related products and services who agreed to REALTOR® Z's terms appeared on her home page under the heading "Preferred Providers". Immediately under that heading read "These vendors provide quality goods and services. Please patronize them."

Buyer A frequented REALTOR® Z's website seeking information about available properties. Using that website, he became aware of a property on Elm Street that he made an offer on through REALTOR® Z, which was accepted by the seller. The sale closed shortly afterwards.

Buyer A was an avid remodeler and, using REALTOR® Z's website, linked to the Real Rug company website, among others. Interested by what he found there, he subsequently visited their showroom in person and purchased wall-to-wall carpeting and several expensive area rugs.

Given the size of Buyer A's order, one of the owners of Real Rug came to oversee the delivery and installation. In the course of conversation with Buyer A, he commented favorably on the amount of referral business received from REALTOR® Z's website. "And to think I only pay a small fee for each customer who's referred to me by REALTOR® Z," he added.

Buyer A was somewhat surprised that REALTOR® Z would receive money for referring clients and customers to providers of real estate-related products and services and contacted the local association of REALTORS®. The association provided him with a copy of the Code of Ethics. Reading it carefully, Buyer A concluded that REALTOR® Z's actions might have violated Article 6, and he filed an ethics complaint against REALTOR® Z.
