MAR 2006 LEGISLATIVE DAY
TOMORROW!!!   Wednesday, January 18, 2006
at the Loews Hotel Annapolis

REALTOR® members from across Maryland are welcome to attend the FREE Legislative Day Program, which begins at 3:30 p.m. The evening reception will begin at 6 p.m. in the hotel atrium. Guests are welcome to attend for a modest $15 to cover drinks and hors d'oeuvres. The reception provides an excellent opportunity for Senators, Delegates and REALTORS® to meet and discuss issues of concern for the upcoming legislative session. 2006 NAR CODE OF ETHICS RELEASED. . .
Several amendments to the Code of Ethics were approved by the NAR Board of Directors for 2006:

  • Standard of Practice 1-13:
    When entering into buyer/tenant agreements, REALTORS® must advise potential clients of:
    1. the possibility that sellers or sellers' representatives may not treat the existence, terms, or conditions of offers as confidential unless confidentiality is required by law, regulation, or by any confidentiality agreement between the parties. (Adopted 1/93, Renumbered 1/98, Amended 1/06)

  • Standard of Practice 1-15:
    REALTORS®, in response to inquiries from buyers or cooperating brokers shall, with the sellers' approval, disclose the existence of offers on the property. Where disclosure is authorized, REALTORS® shall also disclose whether offers were obtained by the listing licensee, another licensee in the listing firm, or by a cooperating broker. (Adopted 1/03, Amended 1/06)
  • Standard of Practice 10-1:
    When involved in the sale or lease of a residence, REALTORS® shall not volunteer information regarding the racial, religious or ethnic composition of any neighborhood nor shall they engage in any activity which may result in panic selling, however, REALTORS® may provide other demographic information. (Adopted 1/94, Amended 1/06)
  • Standard of Practice 10-2:
    When not involved in the sale or lease of a residence, REALTORS® may provide demographic information related to a property, transaction or professional assignment to a party if such demographic information is (a) deemed by the REALTOR® to be needed to assist with or complete, in a manner consistent with Article 10, a real estate transaction or professional assignment and (b) is obtained or derived from a recognized, reliable, independent, and impartial source. The source of such information and any additions, deletions, modifications, interpretations, or other changes shall be disclosed in reasonable detail. (Adopted 1/05, Renumbered 1/06)
  • Standard of Practice 10-3:
    REALTORS® shall not print, display or circulate any statement or advertisement with respect to selling or renting of a property that indicates any preference, limitations or discrimination based on race, color, religion, sex, handicap, familial status, or national origin. (Adopted 1/94, Renumbered 1/05 and 1/06)

2006 EVENT DATES ANNOUNCED. . .

NEW MEMBER ORIENTATION. . . The next New Member Orientation will be held at La Fontaine Bleu this Thursday, January 19 at 11:30 a.m. All new members who have joined the association since January 2004 and HAVE NOT ATTENDED a New Member Orientation MUST ATTEND. Many of PGCAR's Affiliate Members attend the Orientation to provide information and introduce new members to their services. Lunch is served at 11:30 a.m. followed by a program which explains membership and the responsibilities of the association's committees. The orientation is concluded with the 3-hour required Ethics class. If you have not attended the New Member Orientation and require a registration form, please contact the association office at 301-306-7900.

2005 PRODUCTION AWARDS COMPETITION. . . 2005 Awards Rules and Entry Forms have been mailed to all offices. This year's entries must be received NO LATER THAN 5 P.M. ON JANUARY 31. No exceptions! This will be the last PGCAR production-based awards competition. If you would like an awards package sent to you, contact the association office at 301-306-7900.

AWARDS LUNCHEON REGISTRATION NOW OPEN!. . . The Awards Luncheon will be held at the La Fontaine Bleu on March 16 at 11:30 a.m. to 3 p.m. TICKETS:

  Through March 10: $25 for PGCAR Members/$40 for Non-members
After March 10: $50 for PGCAR Members/$65 for Non-members

ANNUAL RPAC FUNDRAISER
ANNUAL RPAC FUNDRAISER The Annual RPAC Fundraiser will be held at the La Fontaine Bleu on April 19. The Fundraiser will have a country/western theme and there will be something for everyone. The committee is hard at work securing items for the silent auction, which always features wonderful items to bid on. Brought back by popular demand is the Texas Hold'em Poker competition. This year we will have a beginners table-no need to be shy if you're not an experienced player.

Code of Ethics Case Study
Case #2-1: Disclosure of Pertinent Facts

REALTOR® A, acting as a management agent, offered a vacant house for rent to a prospective tenant, stating to the prospect that the house was in good condition. Shortly after the tenant entered into a lease and moved into the house, he filed a complaint against REALTOR® A with his Board of REALTORS®, charging misrepresentation, since a clogged sewer line and a defective heater had been discovered, contrary to REALTOR® A's statement that the house was in good condition.

At the hearing, it was established that REALTOR® A had stated that the house was in good condition; that the tenant had reported the clogged sewer line and defective heater to REALTOR® A on the day after he moved into the house; that REALTOR® A responded immediately by engaging a plumber and a repairman for the heater; that REALTOR® A had no prior knowledge of these defects; that he had acted promptly and responsibly to correct the defects and that he had made an honest and sincere effort to render satisfactory service.

It was the Hearing Panel's decision that REALTOR® A was, therefore, not in violation of Article 2.
