Tax Credit Call for Action Update The Call for Action (CFA) asking Congress to "extend and expand" the homebuyer tax credit is still open. NAR has been working hard to get this CFA out there amongst the members, and it seems to be paying off!

More than 125,000 REALTORS® have taken action which is greater than an 11% response rate. That's right, we've passed the hundred thousand mark and ten percent mark!!

The Broker Involvement Program is helping to build our response rates and we hope they will continue to grow. Another push on the CFA has gone out today. FPCs, keep getting the word out and ask others to take action too on this important issue! FPCs, you hit your all-time highest response rate for a CFA - 95.4%!! That is incredible! 42 states have 100% FPC Participation.

There are only a few FPCs left to reach 100% in MD and nation-wide. If you haven't yet responded, please do so today and let's reach that milestone! You can respond directly on the REALTOR® Action Center (you can't miss the brand new pop-up asking you to take action). REALTORS® BEWARE . . . Alleged Robbers Visit Local Open Houses

On a recent Sunday, an NVAR member hosted an open house in Alexandria City, and afterward the home owner discovered that valuable jewelry had been stolen from the bedroom. The REALTOR® shared her experience so that members hosting open houses can be aware and cautious. Alleged perpetrators visited other open houses on that same day, and jewelry was also stolen in those houses.

Possible suspects could be a father and son. The elder is in his early 50s, the son in his mid-20s. Both are white, have brown hair, and are about 5’ 9”. The father claims to be from Columbia, Maryland, and wants to be closer to Metro.

The younger house hunter wandered upstairs as the agent was talking to the father. The father called upstairs to his son and said, "Make sure you take a picture of the hall -- you know how important the hall is to me."

They could be driving a small silver sedan or an older model black Land Rover. They did not park in front of the house. Please have a plan to contact someone in case of an emergency. Create code words or sentences and give to a friend or relative so you can signal if there might be trouble.

REALTOR® Safety Warning - Be Careful at Open Houses

Local REALTORS® have also reported that a white male, around 40 years old, approximately 5’ 9”, has been frequenting high-end open houses and looking inside all of the cabinets in the homes, possibly searching for drugs or other items of value. The man, who states that he is an architect, may be driving a white pick-up truck. Remember to follow standard safety precautions when hosting open houses.

Pending home sales have increased for seven straight months, the longest in the series of the index which began in 2001. The Pending Home Sales Index, a forward-looking indicator based on contracts signed in August, rose 6.4 percent to 103.8 from a reading of 97.6 in July.

Lawrence Yun, NAR chief economist, said not all contracts are turning into closed sales within an expected timeframe. "The rise in pending home sales shows buyers are returning to the market and signing contracts, but deals are not necessarily closing because of long delays." Yun also said the forecast for home sales and prices depends very much on whether a tax credit is extended. "All we can say for certain is sales will decline when the tax credit expires because we are not yet on a self-sustaining recovery path. It also raises a risk of a double-dip recession," he said. "Extending and expanding the tax credit is the best tool in our arsenal to encourage financially qualified buyers to stimulate the economy and help reduce the budget deficit."

NAR President Charles McMillan, noted, "Each home sale pumps an additional $63,000 into the economy through related goods and services, so the benefits of extending and expanding the tax credit far outweigh the costs."

Subregion 6 Master Plan and Sectional Map Amendment (SMA), covering almost one third of Prince George's County, was approved by the Prince George's Council on September 15, 2009. Council Resolution (CR-62-2009) can be found on the Subregion 6 project website.

Historic Sites and Districts Plan Staff Draft

The Prince George's County Planning Department released the Staff Draft of the Historic Sites and Districts Plan (HSDP) on the plan website for public comment on September 25, 2009. A hard copy version of the staff draft will also be available at the Planning Information Services Office located on the lower level of the County Administration Building at 14741 Governor Oden Bowie Drive in Upper Marlboro. All written comments (letter, fax and/or email) will be accepted until COB on Monday, October 26, 2009. Staff will consider those comments as they finalize the document for review by the Planning Board for "Permission to Print."

What are a master plan and SMA?

A master plan is a written report, approved by the District Council, which establishes how the county would like the land in the project area to develop in the future. It establishes recommendations that guide the county officials in making decisions on the use of land within the project boundary. The result of this planning process will be to guide growth in the Developing Tier and promote land preservation in the Rural Tier by creating a sustainable community.

A sectional map amendment (SMA) is a process that establishes the zoning of properties in an area. Zoning is the legal power of government to regulate the use of private property. The SMA may change the existing zoning in the area to permit the land use recommendations in the master plan.

Code of Ethics Case Study: Case #7-1: Acceptance of Compensation from
Buyer and Seller

Buyer A engaged REALTOR® B to locate a small commercial property. Buyer A explained his exact specifications indicating that he did not wish to compromise. They agreed that if REALTOR® B could locate such a property within Buyer A's price range, he - the buyer - would pay a finder's fee to REALTOR® B.

Two weeks later, REALTOR® B called Buyer A to advise that Seller C had just listed a property with him that met all of Buyer A's specifications except that the listed price was a bit higher than Buyer A wanted to pay. Buyer A inspected the property and liked it, but said he would adhere to his original price range. REALTOR® B called Buyer A three days later to say that Seller C had agreed to sell at Buyer A's price. The sale was made and REALTOR® B collected a commission from Seller C and a finder's fee from Buyer A which was not disclosed to Seller C, REALTOR® B's client.

Several weeks later, Seller C learned about the finder's fee that REALTOR® B had collected from Buyer A and filed a complaint with the Board of REALTOR® charging REALTOR® B with duplicity and unprofessional conduct. The complaint specified that when REALTOR® B had presented Buyer A's offer at less than the listed price, he, the seller, was reluctant to accept it, but REALTOR® B had convinced him that the offer was a fair one and not likely to be improved upon in the current market; and that REALTOR® B had dwelt at length on certain disadvantageous features of the property in an attempt to promote acceptance of the offer. The complaint charged that REALTOR® B had actually been the agent of the buyer while holding himself out as the agent of the seller. Further, Seller C asserted that REALTOR® B had never mentioned that he was representing the buyer or intended to be compensated by the buyer.

At the hearing, REALTOR® B's defense was that he had served both buyer and seller faithfully; that he had not accepted Seller C's listing until after he had agreed to assist Buyer A in locating a property; and that in his judgment the listed price was excessive and the price actually paid was a fair price.
