    Real Estate Provisions in "Fiscal Cliff" Bill
    Briefing from NAR on the Recent Legislation

    On January 1, both the Senate and House passed H.R. 8 legislation to avert the "fiscal cliff." The bill was signed into law by President Barack Obama on January 2.

    Below is a summary of real estate related provisions in the bill:

    Real Estate Tax Extenders
    • Mortgage Cancellation Relief is extended for one year to January 1, 2014
    • Deduction for Mortgage Insurance Premiums for filers making below $110,000 is extended through 2013 and made retroactive to cover 2012
    • 15-year straight-line cost recovery for qualified leasehold improvements on commercial properties is extended through 2013 and made retroactive to cover 2012
    • 10 percent tax credit (up to $500) for homeowners for energy improvements to existing homes is extended through 2013 and made retroactive to cover 2012
    Permanent Repeal of Pease Limitations for 99% of Taxpayers

    The agreement permanently repeals so called "Pease Limitations" that reduce the value of itemized deductions (including mortgage interest and property tax) for most taxpayers; however, will reinstitute Pease Limitations for high income filers. These limitations will apply to individuals earning more than $250,000 and joint filers earning above $300,000. These thresholds have been increased and are indexed for inflation and will rise over time. Under the formula, the amount of adjusted gross income above the threshold is multiplied by three percent. That amount is then used to reduce the total value of the filer's itemized deductions. The total amount of reduction cannot exceed 80 percent of the filer's itemized deductions.

    These limits were first enacted in 1990 (named for the Ohio Congressman Don Pease who came up with the idea) and continued throughout the Clinton years. They were gradually phased out as a result of the 2001 tax cuts and were completely eliminated in 2010-2012. Had we gone over the fiscal cliff, Pease limitations would have been reinstituted on all filers starting at $174,450 of adjusted gross income.

    Capital Gains

    Capital Gains rate stays at 15 percent for those in the top rate of $400,000 (individual) and $450,000 (joint) return. After that, any gains above those amounts will be taxed at 20 percent. The $250,000/$500,000 exclusion for sale of principal residence remains in place.

    Estate Tax

    The first $5 million dollars in individual estates and $10 million for family estates are now exempted from the estate tax. After that the rate will be 40 percent, up from 35 percent. The exemption amounts are indexed for inflation.

    DC Broker License Renewal Deadline

    Avoid penalties - Renew before February 28

    DC Broker and Property Manager licenses must be renewed by February 28, 2013. ALL CE Hours must be completed before-hand, then reported. License renewals must be submitted and paid by February 28, 2013. That is the deadline to renew without penalty.

    DC Sales Agents must renew their DC real estate licenses before August 31, 2013.

    Share the news with your homebuyers! Marylanders, mark your calendars. The weekend of Saturday, February 16 through Monday, February 18 (Presidents' Day) will be a tax-free three day weekend during which the sales and use tax will not apply to the sale of selected Energy Star Products, or solar water heaters.

    Energy Star Product means an air conditioner, clothes washer or dryer, furnace, heat pump, standard size refrigerator, compact fluorescent light bulb, dehumidifier, or programmable thermostat that has been designated as meeting or exceeding the applicable Energy Star Efficiency requirements developed by the U.S. Environmental Protection Agency and the U.S. Department of Energy.

    Consumer Tip: New Year's Resolutions for Your Home
    Home Improvement Goals for 2013

    House Cleaning Resolution New Year's resolutions are often the subject of jokes about their likelihood to go unrealized, but for many, this time of year heralds a true turning point.

    Here are four common personal resolutions, translated into equivalents for your home:

    1. Lose weight (cut energy use) - Start with your HVAC system and duct work. Also investigate easy places to install more insulation like attics and crawlspaces. You'd be surprised how energy savings from these improvements can add up over the years. Calculate it right, and you can put the money toward a vacation to reward you for your hard work. -- This is also a great way to "green" your home, which could be a resolution in and of itself.
    2. Quit smoking (purify indoor air) - Did you know indoor air quality is one of the biggest environmental health hazards, according to the EPA? The HVAC improvement you took care of with your first resolution is one of the biggest steps toward improving air quality in your home - change your filters often! Other important steps include using low-VOC paints and having good ventilation in kitchens, bathrooms, and other rooms prone to moisture collection.
    3. Get out of debt (budget for improvements) - A yearly budget will set you up to avoid the pitfalls of overspending, and will allow you to save for unexpected emergency repairs. According to the U.S. Census Bureau, the average yearly home improvement and maintenance expenditure is around $3,300.
    4. Get organized (de-clutter) - There is one step that rises above all the others when it comes to de-cluttering -- storage! Get boxes and shoe organizers, install drawers under beds, and get aesthetically pleasing baskets and racks for the kitchen. You'd be surprised how the clutter will melt away when you have somewhere to put everything.

    Market Sen$e: New Year Sees Mortgage Rates Near All-Time Record Lows


    Results released last Thursday, January 3rd, showed fixed mortgage rates remaining near all-time historic lows entering the new year.

    Freddie Mac Vice President and Chief Economist Frank Nothaft said the continued low rates should do much to aid the ongoing housing recovery.

    "New home sales rose in November to a two-year high and were up 15.3 percent from the previous November. Similarly, pending sales on existing homes increased for the third month in November to the strongest pace since April 2010." Nothaft said.

    Freddie Mac reports the following averages for the week ending January 3, 2013:

    • The 30-year fixed-rate mortgage averaged 3.34%, down from 3.35%.
    • The 15-year fixed-rate mortgage averaged 2.64%, down from 2.65%.
    • The 5-year Treasury-indexed hybrid ARM averaged 2.71%, up from 2.70%
    • The 1-year Treasury-indexed ARM averaged 2.57%, up from 2.56%.

    November settlements on single family homes increased by 5.5 percent over October, and increased 5.7 percent from November 2011.

    Other good news saw new contracts on condos and co-ops increase by nearly 14 percent compared to the same time last year.

    The outlook continues to look brighter for the housing market and mortgage rates are holding steady near all-time record lows. Now is a great time to buy in Prince George's County!

    Sales Coach: Three Critical Items for Ads
    Don't Leave Buyers Guessing


    Home Sales Coach Right up front here are the three most important pieces of information to include in any real estate advertisement: price, location, and number of bedrooms.

    Research has shown that these are the three items most important to potential buyers, so please, just give that information to them.

    According to one study, as many as 58 percent of potential buyers won't request further information if they don't already have some indication of the price. No matter what you are selling, leaving out the price is usually a sign that it is going to be higher than expected.

    When it comes to location, it's important to consider this aspect from all angles - literally. If a photo of the front of the house doesn't divulge the most impressive aspects of the property, use a different angle! Use one looking from the inside out if the inside is beautiful and there is a tremendous view. Don't get stuck in a rut - always play to the advantage.

    Finally, be up front about how many bedrooms the house has and you won't waste time with a buyer whom this is going to be a stumbling block for. If a buyer has three teenagers, chances are there is no chance of you selling them a two bedroom house -- so don't waste your time or theirs by leaving this information out.

    IRS 2013 Standard Mileage Rates

    As of January 1, 2013, the standard mileage rates used to calculate deductible costs of operating a car (also vans, pickups or panel trucks) are:

    • 56.5 cents per mile for business miles driven
    • 24 cents per mile driven for medical or moving purposes
    • 14 cents per mile driven in service of charitable organizations

    Revised Standard of Practice 12-10
    REALTORS®' obligation to present a true picture in their advertising and representations to the public includes Internet content posted, and the URLs and domain names they use, and prohibits REALTORS® from:
    1. engaging in deceptive or unauthorized framing of real estate brokerage websites;
    2. manipulating (e.g., presenting content developed by others) listing and other content in any way that produces a deceptive or misleading result; or
    3. deceptively using metatags, keywords or other devices/methods to direct, drive, or divert Internet traffic; or , or to other mislead consumers
    4. presenting content developed by others without either attribution or without permission,
    5. or to otherwise mislead consumers. (Adopted 1/07, Amended 1/13)
