New Smoke Alarm Laws

The New Smoke Detector Laws - Effective Since January 1, 2018
Practical considerations for you and your clients

A seller who fails to comply with the law is subject to a fine, imprisonment, or both. A listing agent representing a seller who is in violation of the law must disclose to prospective buyers that the seller is not in compliance. If a buyer's agent is aware that the seller is not in compliance with the law, the buyer's agent must disclose this fact to his or her buyer client.

The PGCAR Board of Directors is pleased to announce the hiring of Renada Johnson as Education Manager and Nathalie Solomon as Accounts Receivable Clerk.

Renada Johnson, PGCAR Education ManagerRenada will be responsible for managing, organizing, and growing the PGCAR education offerings. Renada will manage our relationships with the Maryland and DC Real Estate Commissions as well as our online education providers and our stable of quality education instructors. She will work closely with the Board of Directors, Education Committee and the Executive Vice President in directing the Association's Education Program.

Over the past seven years, Renada has worked at the Greater Capital Area Association of REALTORS®. She brings with her a wealth of knowledge and experience. During her tenure at GCAAR, Renada was the Education Coordinator for five years and was promoted to Member Services Representative / DC Office Manager the last two years.

With great enthusiasm and anticipation Renada joins PGCAR. She is looking forward to expanding the educational program to meet our member needs in this ever-changing market. Renada exemplifies strong leadership skills and great work ethic. We are happy to welcome her to the PGCAR team!

Nathalie Solomon, PGCAR Accounts Receivable ClerkOur new Accounts Receivable Clerk, Nathalie Solomon, will undertake a variety of our in-house accounting and bookkeeping needs and provide general office support. She will be working a part-time schedule that allows her to manage our record keeping needs.

Nathalie comes to us with over 40 years of accounting experience. Most recently with Urban Archaeology where she served as Accounts Payable Supervisor for 17 years.

She recently relocated from New York to Prince George's County.

Progress Report: The 2018 Legislative Priorities for REALTORS®

The Maryland General Assembly is just starting its last month of the 2018 Legislative Session. Many PGCAR and Maryland REALTOR® volunteers and staff are busy following and lobbying for these legislative priorities that impact homeownership and our industry. Progress is being made.

First-Time Homebuyer Savings Account - HB 463 / SB 972

The bill would allow any Maryland resident to establish a tax-free account for a designated beneficiary. First-time homebuyers or individuals creating an account for a first-time buyer beneficiary could deposit up to $50,000 (state tax free) in an account. The legislation would require that money deposited in the account be used within 15 years of opening an account. If the money was not used in for a first-time home purchase, the holder of the account would be subject to the state tax and penalties. Issue Sheet >

STATUS: A panel arranged by Maryland REALTORS®, which included Cheryl Abrams Davis, President of the Prince George's County Association of REALTORS®, testified before the House Ways and Means Committee in support of HB 463. It's companion bill, SB 972 is scheduled for a hearing before the Senate Budget and Taxation Committee.

Escrow Trust Accounts - HB 1608

The bill regulates third party companies holding real estate earnest money deposits and establishes numerous duties and requirements related to the activities of escrow agents responsible for trusts established for the purpose of conducting real estate transactions. These deposits were once held almost exclusively by real estate brokers. While there is no legal prohibition against such companies holding earnest money deposits, these third party companies are not subject to the same regulatory requirements as real estate brokers. Consequently, we believe home sellers and buyers would benefit from state law providing basic rules on how the money is deposited, held and disbursed. Issue Sheet >

STATUS: A hearing on the bill was held before the House Environment and Transportation Committee.

Real Estate Guaranty Fund - Fund Transfer - HB 1656 / SB 843

The bill authorizes the State Real Estate Commission to transfer up to $500,000 from the Real Estate Commission Fund to the Real Estate Guaranty Fund if (1) the commission is projected to have at least a $500,000 operating surplus and (2) the amount in the guaranty fund is less than $300,000. The Guarantee fund compensates consumers when a real estate agent has violated their legal obligations. The law also specifies that if the fund falls below $250,000, then all licensees will be assessed an additional fee to recapitalize it. Such authority would help licensees avoid a special assessment of the Commission's general fund is already flush with real estate licensing fees. Issue Sheet >

Business Succession in the Event of Disability - HB 1482 / SB 846

Current law provides direction regarding the continuation of a brokerage after the death of the broker but has no corresponding language providing direction when a broker is disabled and unable to continue operating the company. The bill allows a family member of a disabled real estate broker to temporarily carry on the broker's business for purposes of closing and terminating the business. The authorization is incorporated into existing provisions that allow a family member to temporarily carry on the business of a deceased real estate broker for the same purposes. Issue Sheet >

Although the 2017 Maryland General Assembly rejected legislation that would have expanded the Best Available Technology (BAT) requirement for septic systems to new construction outside of Maryland's Critical Areas, a work group has been studying potentially new septic initiatives. Maryland REALTORS® are opposed to legislation that would extend the BAT requirement outside of the Critical Areas. In addition, the Maryland REALTORS® would oppose mandatory septic pump outs or mandatory inspections of such systems. Issue Sheet >

"The 10-year Treasury yield has been bouncing around in a narrow 15 basis point range for the last month. While the yield on the 10-year Treasury is currently below the high of 2.95 percent reached two weeks ago, mortgage rates are up for the ninth consecutive week," from Freddie Mac Deputy Chief Economist, Len Kiefer. The U.S. weekly average 30-year fixed mortgage rate rose 3 basis points to 4.46 percent in this week's survey, its highest level since January 2014."

Freddie Mac reports the following averages for the week ending March 8:

The 30-year fixed-rate mortgage averaged 4.46%, up from 4.43% ~ Last year: 4.21%
The 15-year fixed-rate mortgage averaged 3.94%, up from 3.90% ~ Last year: 3.42%
The 5-year Treasury-indexed hybrid ARM averaged 3.63%, up from 3.62% ~ Last year: 3.23%
